These Terms of Service ("Terms") constitute a legally binding agreement between you and Call Nara operated by Troxo Pty Ltd ("we," "our," or "us") governing your access to and use of the Call Nara application and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms on the Service, sending you an email notification, or providing an in-app notification, and updating the Last Updated date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
If you do not agree to the modified terms, you should discontinue your use of the Service.
Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, which is incorporated by reference into these Terms.
Call Nara is an AI companion service. Nara is an artificial intelligence, not a human being. Call Nara is:

If you are setting up Call Nara on behalf of a family member or loved one, you represent and warrant that you have the authority to do so and to bind them to these Terms.
Call Nara operates on a free trial model followed by a monthly subscription, designed to ensure fair access for all users and compliance with mobile app store requirements.
Each account is entitled to 10 free exchanges with Nara. These free exchanges are provided on a per-account basis and are not transferable. Once you have used your 10 free exchanges, you will need to subscribe to continue using the Service.
Our subscription is $24.99 USD per month and provides unlimited exchanges with Nara plus access to all features including:

We reserve the right to change our subscription fees at any time. If we change our fees, we will provide notice of the change on the Service or by email at least 30 days before the change takes effect. Your continued use of the Service after the fee change becomes effective constitutes your agreement to pay the updated fee amount.
Our usage limits are designed to ensure fair access to our Service for all users. Attempts to circumvent usage limits, including but not limited to creating multiple accounts or using multiple devices to exceed free exchange allocations, may result in account suspension or termination.
You may cancel your subscription at any time through your device's app store subscription settings or by contacting our customer support team.
When you cancel:
After cancellation, your account will revert to limited access when your current subscription period ends.
For purchases made through mobile app stores, refunds are handled by the respective app store platform according to their refund policies. Please contact your app store platform directly for refund requests.

The Service allows you to add photos for Nara to discuss with you. You retain all rights in your photos and any content you provide, but you grant us a worldwide, non-exclusive, royalty-free licence to use such content solely for the purpose of providing the Service to you.
You represent and warrant that you own or have the necessary rights to provide your content and that your content does not violate the rights of any third party or any applicable law.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NARA IS AN ARTIFICIAL INTELLIGENCE AND HER RESPONSES ARE GENERATED AUTOMATICALLY. THE SERVICE IS INTENDED AS A COMPANION AND MUST NOT BE RELIED UPON AS MEDICAL, LEGAL, FINANCIAL, OR ANY OTHER FORM OF PROFESSIONAL ADVICE. YOU SHOULD ALWAYS EXERCISE YOUR OWN JUDGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CALL NARA, TROXO PTY LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes will be resolved under Australian Consumer Law.
